Who we are

OFF DUTY is a registered trade name of a limited liability company organized under the laws of the State of Florida, United States ("OFF DUTY", "we", "us"). These Terms govern your use of offdutytowels.com and anything you buy from it. By placing an order or using the site, you agree to them.

Eligibility

You must be at least 18, or have the permission of a parent or guardian, to order from this store.

Products

Our products are textiles made in small runs. Colour on your screen will not match the finished fabric exactly, and printed colour, pattern placement and dimensions vary slightly between pieces. That variation is part of how the product is made, not a defect.

Pricing and errors

Prices are in US dollars and may change without notice. We try to describe everything accurately, but if a product, price or availability is listed in error we may correct it, and we may cancel and refund any order placed at an incorrect price, even after you receive a confirmation.

Orders

Your order is an offer to buy. An order confirmation email means we received it, not that we accepted it. We may refuse or cancel any order, including for suspected fraud, unauthorized resale, or quantities beyond normal personal use, and we will refund you in full if we do.

Drops, ballots and waitlists

Products are released in limited drops. Voting in a colourway ballot, joining a waitlist or holding a member number is not an order, does not reserve stock, and does not guarantee that a colourway will be produced. Member numbers and ballot entries have no cash value and are not transferable.

Payment

Payment is taken at checkout, preorders included. By entering payment details you confirm you are authorized to use that payment method.

Shipping, returns and refunds

Our Shipping policy and our Return and refund policy form part of these Terms.

Promotions and codes

Discount codes are single-use unless stated otherwise, cannot be combined, have no cash value, and may be withdrawn at any time.

Intellectual property

The OFF DUTY name and marks, our product designs, surface prints, photography, copy and site content belong to us or our licensors. You may not copy, reproduce, manufacture or create derivative versions of them without our written permission. Buying a product gives you the product, not any rights in its design. Products are sold for personal use; commercial resale requires a written wholesale agreement with us.

Your content

If you post a review, photo or comment, or tag us, you confirm it is yours to share and you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it in our marketing, with credit where practical. You may ask us to stop using it at any time.

Acceptable use

Do not use the site to break the law, scrape it, interfere with its operation, or misrepresent yourself.

Third-party services

The site uses third-party services for payment, shipping, analytics and email, and may link to sites we do not control. We are not responsible for their content or practices.

Disclaimers

The site and products are provided "as is" and "as available", without warranties of any kind beyond those that cannot be excluded under applicable law. Nothing on this site is medical, fitness or professional advice. Use the product sensibly and check that it is secure before you train on it.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Some jurisdictions do not allow these limits, so they may not apply to you.

Indemnification

You agree to indemnify and hold harmless OFF DUTY and its members, officers and agents from any claim arising out of your breach of these Terms or your misuse of the site or products.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Palm Beach County, Florida, and you consent to that venue.

Severability and entire agreement

If any part of these Terms is unenforceable, the rest stays in force. Together with the policies referenced above, these Terms are the entire agreement between us.

Changes

We may update these Terms at any time by posting a revised version here. The Terms in force when you place an order apply to that order.
